The appeals court said there was no constitutional basis for the court to step in and it declined to create one. The judges said Plame and Wilson could bring their case under the Privacy Act, though it does not cover the president or vice president's offices. The court also said it must be reluctant to wade into national security issues.

While Bates did not address the constitutional questions, he seemed to side with administration officials who said they were acting within their job duties. Plame had argued that what they did was illegal and outside the scope of their government jobs.

The file was then transferred to the department's attorney in her own Albuquerque office, where it soon went missing.

Couple Reiterate Claims They Were Punished

Former U.S. ambassador Joseph C. Wilson IV and his wife, former CIA officer Valerie Plame, said yesterday that Vice President Cheney, presidential adviser Karl Rove and other administration officials knowingly lied and abused their power to get revenge against the couple for criticizing President Bush's rationale for going to war in Iraq. Plame, at a joint appearance with her husband at the National Press Club, said she would "much rather" be a CIA operative than a plaintiff in a lawsuit. She said that she and Wilson, both of whom had worked in government for years, filed the suit with "heavy hearts." Wilson said the couple were under "no illusions about how tough this fight will be." But, he said, "the time has come to hold those who use their official positions to exact personal revenge accountable and responsible for their actions."

Cantwell's primary foe turns friend

The Cantwell campaign bills today's event as a "major campaign announcement." Clearly the hope is that without Wilson in the race, the anti-war and liberal criticism will subside. Wilson spoke with liberal blogger David Goldstein, who reported that Wilson had a personal meeting with Cantwell and "came away convinced that she's working to bring our troops home."

President Bush told the special prosecutor in the CIA leak case that he directed Vice President Dick Cheney to personally lead an effort to counter allegations made by former Ambassador Joseph C. Wilson IV that his administration had misrepresented intelligence information to make the case to go to war with Iraq, according to people familiar with the president's statement.

Possible civil suit against Rove

[Former ambassador Joseph] Wilson has talked before about the possibility of filing a civil lawsuit against Rove and others involved in leaking his wife's identity, but he's said he would wait for Patrick Fitzgerald to finish his work first. Now that Fitzgerald appears to be finished, at least with Rove, the attorney for Wilson and his wife, Valerie Plame, seems to be hinting that such a suit may be in the works.

Fitzgerald, the special prosecutor in the CIA leak case.
