    • iTunes DRM runs afoul of Norwegian law

      According to Norwegian news service Afterposten, Consumer Ombudsman Bj�rn Erik Thon has told television news reporters that Apple will either have to change its DRM technology or will face fines. Thon confirmed he’s already in communication with Apple’s lawyers. Afterposten did not detail what laws Thon is accusing Apple of violating, however. At issue is the DRM technology applied to iTunes songs, called FairPlay.

      The Senate passed "the iPod bill" on Wednesday after amending it to address concerns from companies like Apple that had called it "state-sponsored piracy." The bill would guarantee that tunes could play on multiple devices in a way that preserves some copy protection and respects rights established when the work was purchased.

    Ars Technica is skeptical. They provide background on prior versions of this bill and how those bills imploded when they hit the wall that is the recording industry.

    Even the press release from Broucher’s office says:

    “In an effort to address the concerns expressed by content owners, the FAIR USE Act does not contain provisions which would have established a fair use defense to the act of circumvention.

    The legislation instead contains specific exemptions to section 1201 of the Digital Millennium Copyright Act which do not pose a comparable potential threat to their business models.”

    Not holding my breath.
