Time after time, Congress exploited loopholes or violated those rules, a Seattle Times investigation has found. An in-depth examination of the 2008 defense bill found $8.5 billion in earmarks. Of those, 40 percent - $3.5 billion - were hidden.

In its yearlong investigation, the paper built a database of military spending earmarks, culled from small type in budget bills. It married that with information on campaign contributions developed from sketchy reports filed with the Federal Election Commission. The journalists discovered, in the words of The Times' letter to the Natt judges: "People who benefit from earmarks generally give money to those who deliver them." And, The Times said, the public interest often is damaged. It cited T-shirts that could melt under fire and endanger troops, as well as a $4.5 million vessel the Navy had no use for and never took delivery on.
