      President Bush recently declared two large regions of the country "national interest electric transmission corridors," opening the door for the federal government to overrule local and state control over where and when transmission lines are located. This is the first of a four part series discussing the ramifications of the Energy Policy Act of 2005 with respect to electric transmission lines, local control, eminent domain, and federal authority.

    • 'Renewal' not good for Rainier Valley

      An excellent guest editorial in the Seattle PI today described an eminent domain plan I'd heard nothing about - and Mayor "I never met a developer I wouldn't kiss" Nickels is likely behind it. And of course I933 does nothing to stop this kind of Eminent Domain - vote no on 933: Last resort simply means if you're unwilling to sell, you're gone. Just as misleading, the city emphasizes the below-average incomes and above-average poverty and crime rates that exist in Rainier Valley to justify eminent domain. But that's a smoke screen because those problems have absolutely nothing to do with many of the properties the city wants to demolish. Moreover, the city has legitimate tools for dealing with crime and poverty. It can increase police presence or fund neighborhood watch programs. It can offer tax credits for small businesses.

      Idealog: Yes on 933 is Lying to Rural Property Rights Activists about Eminent Domain

      So, the Yes on 933 folks have put together a slick flash animation focusing on how 933 would stop Washington State from invoking Eminent Domain. The problem is it's a gigantic lie. Initiative 933 mentions Eminent Domain only twice in its preamble. None of the acts' operating provisions - the sections that make law - mention eminent domain at all. I'm concerned that the Yes on 933 folks are taking advantage of rural property owners - tapping their resentment at politicians to get them to vote for this initiative. Instead - rural voters are just getting used to push through an initiative that will be a free for all for developers and lawyers.
