      "We ... agree that petitioners have not carried their burden of showing that the risk of pain from maladministration of a concededly humane lethal injection protocol, and the failure to adopt untried and untested alternatives, constitute cruel and unusual punishment," Chief Justice John Roberts said in an opinion that garnered only three votes. Four other justices, however, agreed with the outcome.

      Controller had back turned before Ky. crash - U.S. Life

      Bush FAA caused the Crash: "Earlier Tuesday, the Federal Aviation Administration acknowledged violating its own policies when it assigned only one controller to the airport tower that morning. The policy is outlined in a 2005 directive requiring that control tower observations and radar approach operations be handled separately."

      Systems error - recent runway change kills 50. "Although Blue Grass Airport’s Runway 22 is 7,000 feet, the plane departed from the 3,500-foot general aviation Runway 26. The twin-engine CRJ-100 would have needed 5,000 feet to fully get off the ground, aviation experts said."

      Kentucky governor takes limo across the street

      When Gov. Ernie Fletcher's day is over, he leaves his Capitol office, climbs into a Lincoln Town Car driven by a state trooper and returns to the Governor's Mansion — which is just across the street. Meanwhile, his administration is encouraging Kentuckians to get out and walk more for their health.
