    • Supreme Court Upholds Lethal Injection Use

      "We ... agree that petitioners have not carried their burden of showing that the risk of pain from maladministration of a concededly humane lethal injection protocol, and the failure to adopt untried and untested alternatives, constitute cruel and unusual punishment," Chief Justice John Roberts said in an opinion that garnered only three votes. Four other justices, however, agreed with the outcome.

      Today, however, there are no economic populists on the court, even on the liberal wing. And ever since John Roberts was appointed chief justice in 2005, the court has seemed only more receptive to business concerns. Forty percent of the cases the court heard last term involved business interests, up from around 30 percent in recent years.

      "This is a case about free speech," said Mertz. "It is not a case about drugs." I heard that the kid wasn't even at a school event. Essentially, they are trying to limit free speech of a student when he's outside school grounds and oversight. Can anyone confirm that?

    Supreme Court rejects death for child rape

    I saw today that Obama came out in support of the death penalty for child rape:

    "I have said repeatedly that I think that the death penalty should be applied in very narrow circumstances for the most egregious of crimes," Obama said at a news conference. "I think that the rape of a small child, 6 or 8 years old, is a heinous crime and if a state makes a decision that under narrow, limited, well-defined circumstances the death penalty is at least potentially applicable, that that does not violate our Constitution."
