Justice Kennedy warns ABA of 'slight foreboding'

      Posted by Billbar from Rawstory

Justice Anthony M. Kennedy, the third most senior judge on the Supreme Court who has often been its swing vote, addressed the state of the rule of law in America and globally on August 5, 2006. His remarks came during the keynote address at the ABA's Annual meeting in Honolulu, Hawaii. "We are at another turning point in the history of the law," Kennedy remarked. Discussing the importance of an independent judiciary, Kennedy added, "I sense a slight foreboding, I sense that we are not making the case as well as we ought."

Justices KO law on political funds

      Posted by Jeff from MSNBC

Bush's right wing court overturns Vermont's spending limits. When will the Court decide that democracy is endangered by money in politics - and that this trumps free speech in political campaigns? When the Court is no longer packed with biased corporatists.

    • High court upholds Oregon assisted-suicide law

      Posted by Jeff from MSNBC

"Justices, on a 6-3 vote, said the 1997 Oregon law used to end the lives of more than 200 seriously ill people trumped federal authority to regulate doctors. New Chief Justice John Roberts backed the Bush administration, dissenting with the majority for the first time." Huge victory for individual rights. You can see how Roberts would vote on abortion.

"Any activist will tell you they'd rather have the issue out there than to have it resolved," says this pro-choice Republican, who has worked on the Hill and for various Republican interest groups. "If Roe were overturned, we'd be electing Democrats as far as the eye can see." Clift gets at the ultimate hypocrisy of GOP leadership - they're using the religious right. They'll never actually overturn Roe and Alito is probably on board with that.

NYT Lock and Load - Supreme Court Ruling on Gun Rights

An extremely well written argument against yesterday’s right-wing ruling on the Court.

Supreme Court rejects death for child rape

I saw today that Obama came out in support of the death penalty for child rape:

"I have said repeatedly that I think that the death penalty should be applied in very narrow circumstances for the most egregious of crimes," Obama said at a news conference. "I think that the rape of a small child, 6 or 8 years old, is a heinous crime and if a state makes a decision that under narrow, limited, well-defined circumstances the death penalty is at least potentially applicable, that that does not violate our Constitution."

Life in prison is good enough…if they survive. It’s not like child rapists get to live the life of Reilly(Riley?) in prison.
