      The world's largest naval war games will go on as planned, with the 35 warships from the United States and seven Pacific Rim countries allowed to use active sonar. Yesterday, a federal court in California approved a settlement that requires safeguards, including a 25-mile sonar-free buffer zone around the Northwestern Hawaiian Islands Marine National Monument recently created by President Bush, and significant increases in monitoring for marine mammals during sonar drills.

      The temporary restraining order, sought by environmentalists, came three days after the Defense Department granted the Navy a six-month exemption from certain federal laws protecting marine species to allow use of the "mid-frequency active sonar.'' The Navy's failure to take a "hard look'' at the environmental impact of war games was an "arbitrary and capricious'' violation of the National Environmental Policy Act, U.S. District Judge Florence-Marie Cooper wrote.

    • Pentagon exempts Navy from whale protection law

      The Pentagon on Friday exempted the Navy for six months from a law protecting whales and other marine mammals, a move that may allow planned naval exercises using military sonar to proceed despite a lawsuit. "The Navy will continue to employ stringent mitigation measures to protect marine mammals during all sonar activities, to include habitat controls, safety zones around ships, trained lookouts, extra precautions during chokepoint exercises, in coordination with National Marine Fisheries Service," said Rear Adm. James Symonds, director of environmental readiness.

      Mass whale deaths tied to U.S. Navy sonar

      The U.S. Navy's deployment of active sonar to detect submarine activity is believed to have been responsible for at least six incidents of mass death and unusual behavior among pods of whales in the last 10 years, according to a recent U.S. Congressional Research Service report.
