YouTube Fires Back At Viacom

As we say in the legal profession, 'issue has been joined' in Viacom v. YouTube. In its answer to Viacom's complaint (PDF), filed Friday, YouTube says Viacom's lawsuit is intended to 'challenge... the protections of the Digital Millennium Copyright Act ("DMCA") that Congress enacted a decade ago to encourage the development of services like YouTube.' It goes on to say that the suit 'threatens the way hundreds of millions of people legitimately exchange information, news, entertainment, and political and artistic expression.'

Sen. Joseph Lieberman, I-Conn., called Monday for YouTube to take down al-Qaida videos that users had posted, but the site said most of the videos his office had flagged did not contain material that violated their guidelines and rejected his request that they act to remove all material from U.S. designated terror groups.

YouTube has promised a commercial-free zone in the near future to help Congress deal with the problem of hosting campaign videos that were technically breaking the rule of not redirecting constituents to a commercial site.

What's the big deal? Flickr, which is owned by Yahoo, is hardly about to slay the Goliath that is Google's YouTube. But while this may not sound like an online revolution, it does significantly enhance the Flickr experience for its 42 million monthly visitors. Kakul Srivastava, the company's director of product management, calls these short videos 'long photos' moving snapshots that people can take with their point-and-shoot digital cameras.
